REGULATIONS

What you need to know if you rent out in Madrid

Updated October 2026

Madrid is not a stressed housing area

The regional government has not requested the designation, so in a new contract you agree the rent freely. What does affect you, as everywhere in Spain: until 31 December 2027 the annual increase cannot exceed 2 % without agreement, and there is no increase if the rent is above the reference index for your apartment.

The deposit is lodged with the regional government within 30 working days

One month’s rent, with the Social Housing Agency. For seasonal contracts signed before 8 October 2026 it was two months. Late lodging carries a 2 % surcharge (5 % after more than a year), and failing to lodge it can be fined up to €90,151.82.

If you rent out, Madrid lets you deduct from your income tax

10 % of what you spend on repairs, rent default insurance, contract formalisation or the energy certificate, up to €154.65 a year. And €1,000 if the apartment had been empty for at least a year and you rent it out for three years or more. Both require the deposit to have been lodged.

Seasonal rentals can no longer be used for just anything

Since 8 October 2026 they require a genuine reason for temporary relocation, stated in the contract, and cannot exceed 12 months. Without a reason, it is a five-year long-term contract.

Listings must show the energy label

Royal Decree 390/2021 requires it on any portal or website. In Madrid no habitability certificate is needed; it was abolished in 2018.
